This Legal Disclaimer ("Disclaimer") applies to the Xenon Intelligence platform (the "Platform"), including all products presented as Signal, Workspace, and Feed, together with all related tools, dashboards, APIs, websites, landing pages, content, outputs, and communications operated or provided by Xenon Intelligence Cyber Security Consultancy L.L.C. ("Xenon Intelligence", "we", "us", "our"), a company established in the Emirate of Dubai, United Arab Emirates.
This Disclaimer should be read together with our Terms & Conditions and Privacy Policy, which are incorporated herein by reference. In the event of any conflict between this Disclaimer and the Terms & Conditions, the Terms & Conditions will prevail.
By accessing or using the Platform or any related materials, you acknowledge and agree to the provisions of this Disclaimer.
1. No Legal, Financial, or Professional Advice
All information, content, dashboards, reports, outputs, and other materials made available through the Platform or related communications (collectively, the "Information") are provided for general informational purposes only. Unless explicitly stated otherwise in a separate signed agreement: • The Information does not constitute legal advice, financial advice, investment advice, tax advice, compliance advice, or any other form of professional advice. • The Information should not be relied upon as a substitute for independent professional judgment, legal counsel, financial advisors, or other qualified professionals. • You remain solely responsible for obtaining appropriate professional advice before taking or refraining from any action based on the Information. No solicitor–client, attorney–client, advisor–client, or fiduciary relationship is created by your use of the Platform or by receiving any Information from us.
2. Informational and Investigative Nature of Outputs
The Platform is designed to assist vetted professional users in conducting lawful investigations, analysis, and intelligence-related activities. Any outputs generated through the Platform (including but not limited to dossiers, visualisations, graphs, AI-generated text, summaries, assessments, scores, and risk indicators) are: • Informational in nature; • Derived from a combination of Customer Data, open-source intelligence (OSINT), third-party datasets, and AI or algorithmic processing; and • Subject to error, incompleteness, bias, and limitations inherent in such sources and methods. You acknowledge that: • Outputs may be inaccurate, outdated, incomplete, or misinterpreted if used without context or verification; • The Platform does not guarantee identification of all relevant facts, exposures, threats, or relationships; • You must apply your own expertise, judgment, and independent verification before relying on any output; • You remain fully and solely responsible for how you interpret, use, or act upon any Information or outputs provided by or through the Platform.
3. No Guarantee of Accuracy, Completeness, or Timeliness
While we endeavour to provide reliable Services, we do not guarantee that: • The Information or outputs are accurate, complete, current, or suitable for any specific purpose; • All relevant data sources have been consulted or integrated; • The Platform will identify every risk, threat, vulnerability, relationship, or issue relevant to your use case; or • Any specific investigation, due diligence effort, or analysis will achieve a particular outcome or result. All use of the Information and the Platform is at your sole risk.
4. Third-Party Data, Services, and Links
The Platform may rely on, integrate with, or provide access to: • Third-party databases (including leaked credential databases and other breach or security repositories); • OSINT platforms, APIs, and tools; • AI model providers and large language models; • Cloud hosting, logging, monitoring, and analytics providers; • External websites, platforms, or resources accessible via links. You acknowledge and agree that: • We do not control and are not responsible for the availability, accuracy, legality, or performance of any third-party services, data, or websites; • Third-party content may be incomplete, inaccurate, outdated, or removed without notice; • Your access to or use of third-party services may be governed by separate terms and privacy policies of those providers; you are solely responsible for reviewing and complying with them; • Any links or integrations are provided for convenience only and do not constitute endorsement, recommendation, or guarantee by Xenon Intelligence. We disclaim all liability arising out of or related to third-party services, data, or websites.
5. AI-Generated Content and Limitations
The Platform may use AI and large language models to support: • Summarisation, drafting, and analysis of data; • Identification of patterns or relationships; and • Suggestions of investigative leads or hypotheses. You understand and agree that: • AI-generated content may contain errors, hallucinations, inaccuracies, or biased inferences; • AI outputs are not facts and must be treated as unverified suggestions or drafts requiring independent review; • AI may infer or suggest relationships or risks that are hypothetical, probabilistic, or context-dependent, and may not reflect real-world truth; • You must independently verify AI-generated content before relying upon it in any decision, report, or communication. Xenon Intelligence does not warrant, guarantee, or assume responsibility for the accuracy or completeness of any AI-generated content.
6. No Guarantee of Legal or Regulatory Compliance
The Platform is a tool that can support investigations, risk assessments, and compliance work. However: • Using the Platform does not, by itself, ensure compliance with any law, regulation, industry standard, policy, or internal procedure. • You remain solely responsible for: - Determining whether your use of the Platform is lawful in each relevant jurisdiction; - Ensuring you have a valid legal basis for processing personal data or conducting investigations; - Complying with all applicable laws relating to privacy, data protection, surveillance, sanctions, export control, financial regulations, and sector-specific rules. Xenon Intelligence assumes no responsibility for your compliance obligations and will not be liable for any fines, penalties, or legal consequences arising from your use of the Platform.
7. User Responsibility for Investigations and Decisions
You expressly acknowledge and agree that: • You, not Xenon Intelligence, determine the scope, targets, methods, and legal basis of any investigation or analysis conducted using the Platform. • You are solely responsible for: - Ensuring that all investigative activities are lawful, necessary, and proportionate; - Notifying or informing relevant individuals or authorities where required by law; - Avoiding harassment, discrimination, defamation, or other unlawful targeting of individuals or entities; and - Any decisions, actions, or recommendations made on the basis of Information or outputs from the Platform. Xenon Intelligence is not a party to your investigations and does not direct or control your use cases. We disclaim any responsibility and liability for how you choose to use the Platform or interpret its outputs.
8. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, THE INFORMATION, AND ALL RELATED CONTENT, FEATURES, AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. Without limiting the foregoing, Xenon Intelligence expressly disclaims: • Warranties of accuracy, completeness, reliability, or fitness for a particular purpose; • Warranties of non-infringement, merchantability, or satisfactory quality; • Warranties that the Platform or Information will be uninterrupted, secure, error-free, or free from harmful components; • Warranties that the use of the Platform will produce any specific business, investigative, risk, compliance, or financial outcome. Any reliance you place on the Platform or the Information is strictly at your own discretion and risk.
9. Limitation of Liability (Summary)
Your attention is drawn in particular to the Limitation of Liability provisions in our Terms & Conditions, which are incorporated herein by reference. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) XENON INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE PLATFORM OR INFORMATION; AND (B) OUR TOTAL AGGREGATE LIABILITY IN CONNECTION WITH THE PLATFORM AND INFORMATION SHALL BE LIMITED IN ACCORDANCE WITH THE CAP AND CONDITIONS SET OUT IN THE TERMS & CONDITIONS. If you are dissatisfied with the Platform or any Information, your sole and exclusive remedy is to discontinue use and, where applicable, terminate your subscription in accordance with the Terms & Conditions.
10. Forward-Looking Statements and Risk
Where any content, analysis, or commentary provided through the Platform or related materials contains forward-looking statements, forecasts, or assessments of future events (e.g. security trends, geopolitical scenarios, or risk outlooks): • Such statements are inherently uncertain, based on assumptions, and subject to risks beyond our control; • Actual outcomes may differ materially from any projections or scenarios presented; and • Xenon Intelligence has no obligation to update or revise such statements. You should not place undue reliance on any forward-looking or predictive content.
11. Jurisdictional and Regulatory Considerations
The Platform is primarily intended for use by vetted professional users in jurisdictions where its use is lawful and appropriate. • We do not represent or warrant that the Platform or Information is suitable for, or compliant with, all jurisdictions or regulatory regimes. • You are responsible for ensuring that your access to and use of the Platform is lawful in the jurisdiction(s) in which you and your data subjects are located. • If use of the Platform is illegal or restricted in your jurisdiction, you must not use the Platform.
12. Changes to This Disclaimer
We may update or amend this Legal Disclaimer from time to time to reflect: • Changes to the Platform or underlying technology; • Legal or regulatory developments; or • Adjustments to our business or risk posture. When we make material changes, we will update the "Effective date" at the top of this Disclaimer and will provide at least fourteen (14) days' advance notice where practicable (e.g. via email or in-platform notification). Your continued use of the Platform after any changes become effective constitutes your acceptance of the updated Disclaimer.
